1. About these terms

These terms apply to the website adscreativespace.com and to the design and consultancy services of Atish Dipankar'S Creative Space (“ADS Creative Space”, “we”, “us”), Room No. 13, 1st Floor, Sky City Mall, Gangarampur, Dakshin Dinajpur, West Bengal 733124.

By using this website, booking a consultation or engaging us for a project, you (“the client”) agree to these terms. Where we sign a written agreement or quotation with you for a project, that document applies together with these terms; if the two differ, the signed document prevails.

2. Use of this website

• Information on this website (services, packages, rates, timelines) is a general guide and may change without notice. The fee for your project is the one in your written quotation.
• Project photographs, drawings and renders on this website show our work and are protected by copyright. Please don't copy, reuse or publish them without our written permission.
• Links to other websites are for convenience; we are not responsible for their content.

3. Enquiries and consultations

• A design consultation is charged from ₹1,499 (or as quoted when you book). The fee is payable before or at the consultation.
• If you engage us for a design package for the same project within 90 days of the consultation, the consultation fee you paid is adjusted against the package fee.
• A consultation can be rescheduled with at least 24 hours' notice. Once a consultation has taken place, its fee is not refundable.
• Site visits outside a package are charged separately, as quoted.

4. Quotations and starting work

• Every project starts with a written quotation setting out the scope, deliverables, fee and payment stages. A quotation is valid for 15 days from its date unless it says otherwise.
• Work begins when you accept the quotation and the signing advance is received. Timelines run from that date.
• Work not listed in the quotation is outside the scope and is quoted separately.

5. Fees and payment

• Payments are made by UPI or bank transfer to the account shown on our quotation, bill or receipt. We issue a receipt for every payment.
• We do not accept cash of ₹2,00,000 or more from one person in a day, as required by the Income Tax Act.
• We are currently not registered under GST, so no GST is charged. If this changes, GST will be shown separately on invoices as required by law.
• Drawings for the next stage are released when the payment for the current stage is received. If a payment is overdue, we may pause work until it is cleared, and the timeline extends accordingly.

6. Scope, revisions and changes

• Every package includes two rounds of revisions at each design stage. Further revisions are charged extra.
• Changes to an approved design (for example a new layout after the plan is approved, an added floor, or a change of use) are a change in scope and are quoted separately.
• Unless listed in your quotation, the following are not included: structural design and drawings, MEP (electrical, plumbing, HVAC) design, soil tests and surveys, government and municipal approvals, statutory fees, and landscape design.
• Working drawings are architectural drawings. Structural drawings must be prepared and certified by a qualified structural engineer.

7. Your responsibilities

• Give us accurate information: site dimensions, land documents, setbacks, local rules you know of, budget and requirements.
• Give approvals and feedback in good time. Delays in approvals, payments or information extend the timeline.
• Obtain all permissions needed for construction (building plan sanction, NOCs and similar) unless we have agreed in writing to assist with them.
• Check measurements on site before construction or fabrication. Figured dimensions take precedence over scaled ones.

8. Construction and execution

• Our role is design and consultancy. Contractors, vendors and workers are engaged and paid by you unless a separate written agreement says otherwise, and they are responsible for the quality and safety of their work and materials.
• Site visits and supervision are periodic, to check that work follows the design. They are not continuous supervision, and do not make us responsible for the contractor's methods, safety on site, or defects in workmanship or materials.
• Any execution or coordination work we take on is covered by its own written agreement and quotation.

9. Drawings, designs and copyright

• All documents, drawings, designs, renders, 3D views, walkthroughs, models and other material created by ADS Creative Space are the property of the firm and remain our intellectual property (copyright), including after the project is complete.
• Once our fees are paid in full, you have the right to use them to build the project they were made for, once, at that site. They may not be reused for another site or building, sold, or given to others without our written permission.
• We may display this material, and photographs of the completed project, in our portfolio, on our website and social media, and in brochures, presentations and other advertising material. We do not publish your personal details, contact information or full site address.
• This does not apply where we have signed a non-disclosure agreement (NDA) or a written confidentiality clause with you for the project; in that case its terms decide what we may show.
• Renders and 3D views show the design intent. Actual colours, materials, finishes and light on site may differ.

10. Pausing, cancellation and refunds

• You may end the engagement at any time by telling us in writing. Fees for stages completed, and for work in progress up to that date, are payable.
• The signing advance is not refundable once work has started.
• If a project is put on hold by the client for more than 3 months, we may revise the remaining fee and timeline before restarting.
• We may end the engagement if payments remain unpaid after reminders, or if we are asked to do something unsafe or unlawful. Fees for work done until then remain payable.

11. Limitation of liability

• We carry out our work with reasonable skill and care. Our total liability for any project is limited to the fees paid to us for that project.
• We are not liable for indirect or consequential losses (such as loss of rent, business or profit), for delays or refusals by authorities, or for loss caused by contractors, suppliers, or information given to us that turned out to be incorrect.

12. Privacy

• When you contact us or fill a form on this website, we collect your name, phone number, email, location and project details. We use them only to reply to you and to carry out your project.
• We do not sell or share your details with others, except people working on your project (for example a contractor you've asked us to coordinate with), or where the law requires it.
• Your details are stored securely and access is limited to our team. To see, correct or delete your details, email adscreativespace@gmail.com.

13. Governing law and disputes

These terms are governed by the laws of India. If a disagreement arises, we will first try to settle it by discussion in good faith. If it can't be settled within 30 days, the courts at Dakshin Dinajpur, West Bengal have jurisdiction.

14. Changes to these terms

We may update these terms from time to time; the date at the top shows the latest version. The terms in force when you accepted your quotation apply to that project.
